Mr. O'Leary is a mediator and arbitrator exclusively with ADR Chambers.
Mr. O'Leary retired as a judge of the Court of Appeal of Alberta in September, 2006 after 12 years on the Court. Prior to his appointment to the Court of Appeal, Mr. O'Leary was a trial judge on the Court of Queen's Bench of Alberta for 11 years. As a trial and appellate judge he has written and participated in many significant decisions in a variety of areas of law, including tort liability and damage assessment, corporate and commercial, contract interpretation, employment, insurance, oil and gas, regulatory, municipal, real estate and property, judicial review, family law and civil procedure. Following his retirement from the Bench,.Mr. O'Leary was granted the title of Queen's Counsel, in January , 2008.
Mr. O'Leary was admitted to the Law Society of Alberta in 1963 and practiced in Calgary until his appointment to the Court of Queen's Bench in 1983. He conducted a general practice with emphasis on civil litigation in the areas of personal injury, insurance, corporate and commercial, oil and gas, employment, family, wills and estates, and real estate and property law.
He was a member of the Legal Aid Appeal Committee and the Legal Aid Account Taxation Appeal Committee for several years. He acted as Chairman in Calgary of the Board of Referees under the Unemployment Insurance Act between 1970 and 1975.
Mr. O'Leary was born in Vulcan, Alberta. He attended elementary and secondary schools in Calgary. He attended the University of Denver on a hockey scholarship and graduated with a Bachelor of Science in Business Administration. He studied law at the University of British Columbia where he won many academic awards including the gold medal for highest standing in the 1962 graduating class. He then attended Harvard Law School on an academic scholarship and earned the degree of Master of Laws in 1963.
Mr. O'Leary has had an ongoing interest in legal education. He administered the Bar Admission Course on behalf of the Law Society of Alberta from 1975 to 1978. For several years prior to 1976 he was a member of the joint Canadian Bar Association/Law Society of Alberta Committee on continuing legal education. He was one of the founding directors of the Legal Education Society of Alberta and served as its Chairman for two years and as a director of the Society for many years. From 1974 to 1978 he was the director of the commercial law program for the Society of Industrial Accountants.
Mr. O'Leary is a member of the Board of Directors of the Legal Archives Society of Alberta. He has been active in the affairs of the Canadian Bar Association, Alberta branch. For a number of years he was involved in the administration of minor hockey in Calgary.
